BALI WATER SPORTS – TERMS & CONDITIONS, PARTICIPATION AGREEMENT, SAFETY RULES & LIABILITY WAIVER

This Agreement governs all activities conducted through Bali Water Sports and its affiliated operators, including but not limited to Jet Ski rental, Sea Walker, Diving, Parasailing, Banana Boat, Doughnut rides, and all other water-based recreational services. By booking, paying for, or participating in any activity offered, you confirm that you have read, understood, and agreed to all terms described in this Agreement. These provisions are designed to ensure your safety, protect our staff and equipment, and define responsibilities and liabilities associated with marine activities.

1. PARTICIPATION REQUIREMENTS

All participants must be in adequate physical and mental condition to safely engage in water sports. You must be free from any condition that may impair judgment, coordination, balance, physical ability, breathing, or reaction time. If you suffer from heart disease, asthma, epilepsy, diabetes, recent injuries, physical limitations, respiratory issues, pregnancy, or any condition that may affect your safety, you are required to disclose this prior to participating. Failure to disclose a condition transfers full responsibility to you for any related incident.
You are required to follow all instructions provided by instructors, staff, guides, safety personnel, and operational supervisors. Ignoring instructions, refusing guidance, acting irresponsibly, or operating in an unsafe manner will result in immediate termination of your activity without refund.
The consumption of alcohol, illegal drugs, or any substance that may impair judgment or coordination is strictly prohibited before and during participation. If you are suspected of impairment, you will be refused service or removed from the activity without refund.
We reserve the right to deny participation to any individual who appears unfit, unstable, aggressive, argumentative, non-compliant, or unsafe. You are responsible for your personal belongings; Baliwatersports.com does not cover any loss, theft, or damage of personal property.

2. GENERAL SAFETY REQUIREMENTS

All required safety equipment must be worn exactly as instructed. Life jackets, helmets, masks, or any equipment provided must remain properly fastened at all times. Tampering with or removing safety equipment without approval is prohibited.
Participants must maintain safe operational distancing from all boats, other Jet Skis, paddlers, swimmers, and obstacles. The required safe operating distance is 20 meters. Distances shorter than 20 meters are unsafe and strictly prohibited. Staff instructions regarding distancing must be respected at all times.
Children under 15 years of age or shorter than 145 centimeters must be accompanied by a responsible adult at all times. No under-18 solo operation is permitted. Parents or legal guardians assume full responsibility and liability for any minor participating in activities.
Activities may be postponed, suspended, or cancelled if weather or sea conditions become unsafe, including heavy rain, lightning, strong winds, dangerous currents, or operational issues. Decisions made by staff regarding safety conditions are final.
A safety briefing is mandatory before participating in any activity. If you fail to attend or fail to understand any part of the briefing, you must request clarification before continuing.

3. JET SKI OPERATING RULES

Jet Ski operation requires strict adherence to the following rules:
You must remain at least 20 meters from the shoreline at all times. Approaching closer than 20 meters constitutes a safety violation. You must also maintain at least 20 meters of distance from other Jet Skis, boats, swimmers, and water users at all times.
Wave jumping is not permitted under any circumstances. If you intentionally jump waves or operate the Jet Ski in a reckless manner, your rental will end immediately without refund.
You may not leave the designated riding area. You must keep visual contact with the lead guide or rescue support team at all times.
When entering or exiting the beachfront zone, you must travel in single file and maintain a 6-knot no-wash speed until reaching the open water. The same rule applies on return.
You are responsible for monitoring your surroundings and must yield to all other water users. You must operate the Jet Ski safely and be prepared to adjust your speed and direction to avoid hazards.
A properly fitted life jacket must be worn at all times during Jet Ski operation. This is mandatory and non-negotiable.
When your rental time ends, you must return immediately to the designated rendezvous point. A late return fee of Rp 50,000 per minute will apply for any delay.
If you experience difficulty, distress, or feel unsafe at any time, you are responsible for signaling the support team by raising both arms. If safe, remain on your Jet Ski; if not, your life jacket will provide flotation until help arrives.
You are responsible for your own safety and for the safe operation of the Jet Ski. If staff determine that you are operating unsafely, ignoring instructions, causing risk, lacking control, or endangering others, your rental will be terminated immediately without refund.

4. ACTIVITY-SPECIFIC RULES

Participants engaging in Sea Walker or Diving activities are prohibited from touching, collecting, or damaging coral, marine life, or underwater structures. Certified divers must provide valid certification before the activity.
Parasailing participants must comply with all weight and operational limits; these limits are mandatory.
Participants on Banana Boat or Doughnut rides must hold the designated handles firmly for the entire duration of the ride and must follow the towing operator's instructions.
Jet Ski operators must be at least 18 years old. Participants under 18 may ride only as passengers accompanied by an adult.
Photo and video documentation may be taken during activities with your consent. If you do not wish to be included, you must inform staff before the activity begins.

5. BOOKING AND PAYMENT TERMS

All bookings must be made through the official website Baliwatersports.com. Bookings are confirmed only after the required deposit is paid through the STRIPE International Payment Gateway.
The deposit amount varies depending on the selected activity or package and is clearly displayed on the checkout page before payment.
By proceeding with payment, you acknowledge and agree to the deposit amount shown at checkout.
Deposit amounts are non-negotiable and determined by the system based on operational requirements.
Full Cash payments at the location do not qualify for online prices. Manual peer-to-peer transfers are not accepted.
Remaining balance after deposit is made is payable on arrival. Cash is preferred. 3% bank processing fee applies to all credit card payments at the location.
Booking confirmation, electronic invoice and tickets with official operators' site will be sent via email (info@baliwatersports.com) and WhatsApp for double confirmation.
Prices may change at any time due to operational or economic factors. Once a booking is paid and confirmed, the price is locked for that specific reservation. Online discounted rates apply only to online prepaid bookings.

6. CANCELLATION AND REFUND POLICY

If you cancel more than 24 hours before your scheduled activity, you are entitled to a full refund. Cancellations made within 24 hours result in a 50% charge. Failure to appear results in a 100% charge with no refund.
If the operator cancels due to weather or operational conditions, you may reschedule or receive a full refund for any activity that has not yet begun.
Once your activity has started, no refunds are issued for any reason, including fear, discomfort, inability to operate equipment, seasickness, early withdrawal, rule violations, or negligence.

7. RISK ACKNOWLEDGMENT

Water sports by nature involve risks, including collisions with objects or watercraft, falls, sudden movements, equipment failure, unpredictable wave or weather conditions, and risks associated with your own actions or the actions of others.
You acknowledge that conditions may change without warning and that emergency response may be delayed due to marine conditions. You understand that other participants may cause injury to you, and you may cause injury to others. You acknowledge that participating in water sports involves the risk of serious injury or death.
You confirm that you are not under the influence of alcohol, drugs, or impairing medication and have no medical condition preventing safe participation.
By purchasing from Baliwatersports.com, you voluntarily agree to all Terms and Conditions contained in this Agreement. You acknowledge that these Terms and Conditions apply to every activity you participate in, whether operated directly by Baliwatersports.com or by any of our onsite operators or partners. By proceeding with your booking and participation, you accept all risks associated with marine activities, including those arising from environmental conditions, equipment use, and the actions of yourself or others.

8. DAMAGE LIABILITY

You accept full financial responsibility for any damage to equipment caused by misuse, negligent operation, ignoring instructions, driving too close to the beach, colliding with coral or obstacles, sucking sand or debris into the intake, flipping the Jet Ski, hitting buoys, or returning late.
Damage costs may include:
Minor Hull / Body scratches: Rp 500,000 – 2,000,000
Hull / Body cracks/deep damage: Rp 5,000,000 – 7,000,000
Broken mirror/handlebar: Rp 1,000,000 – 5,000,000
Torn seat/upholstery: Rp 1,500,000 – 5,000,000
Intake grate/impeller damage from coral or sand: Rp 3,000,000 – 5,000,000
Engine damage from negligent operation: Up to Rp 15,000,000 - 35,000,000
Lost key or safety lanyard: Rp 500,000 – 2,000,000
Full recovery/towing due to rider fault: Rp 1,000,000 plus fuel and time
Damage assessments are conducted by the operator based on visible and mechanical inspection.

9. LIABILITY RELEASE AND INDEMNITY

By participating, you release and indemnify Baliwatersports.com, Legendary Jet Ski Experience, Aurora FX Technology LLP, their owners, staff, agents, instructors, and venue operators from any and all liability for injury, death, loss, or damage arising from your participation, except in cases of proven gross negligence.
You accept full legal responsibility for your actions and agree to indemnify the operator from claims made by third parties as a result of your conduct.
This release does not apply to liability that cannot be excluded under applicable law.

10. MEDICAL CONSENT

You consent to receive medical treatment in the event of an emergency. Insurance may cover some expenses; any cost beyond coverage is your responsibility.
Insurance, where provided by licensed local water sports operators, does not cover any damage to equipment resulting from rider negligence, misuse, reckless operation, or violations of safety rules and operating instructions.

11. GOVERNING LAW

This Agreement is governed by the laws of the Republic of Indonesia. Any disputes shall be resolved exclusively in the courts of Bali, Indonesia.

12. DIGITAL ACCEPTANCE & CONFIRMATION

By completing a purchase on Baliwatersports.com, you confirm that you have read, understood, and agreed to all Terms and Conditions, Safety Rules, the Liability Waiver, and the Jet Ski Rental Agreement contained in this document. You understand that your online purchase acts as your digital signature, and that this Agreement is legally binding in the same manner as a handwritten signature.
You also confirm that the full name you provide during checkout is accurate and matches your passport or official identification. You acknowledge your responsibilities, accept all associated risks, and agree to comply fully with all safety instructions, operational rules, and requirements provided by Baliwatersports.com and its onsite operators.
This Agreement applies to all activities you participate in, whether operated directly by Baliwatersports.com or by our onsite partners.
